INSTITUTIONAL COOPERATION FRAMEWORK AGREEMENT BETWEEN THE TRUTH AND RECONCILIATION COMMISSION AND THE NETWORK FOR THE DEVELOPMENT OF SOCIAL SCIENCES

This document certifies the Institutional Cooperation Framework Agreement entered into on the one hand by the Truth and Reconciliation Commission, hereinafter THE COMMISSION, created through Supreme Decree N° 065-2001-PCM, complemented by Supreme Decree N° 101-2001-PCM, duly represented by its President, Salomón Lerner Febres, identified with DNI N°08771655, appointed to such position by Supreme Resolution N°330-2001-PCM and authorized by Ministry Resolution N° 212-2001-PCM to enter into agreements with private sector entities, with legal domicile on Av. Salaverry 2802, district of San Isidro, province and department of Lima, and on the other hand the Network for the Development of Social Sciences in Peru, hereinafter THE NETWORK, made up by Pontificia Universidad Católica del Perú, Universidad del Pacífico and Instituto de Estudios Peruanos and represented by its executive director Mr. Jorge Bracamonte Allaín, identified with L.E. N° 06408853, with Legal domicile on Plaza Francia 1164, Lima 1, in the following terms and conditions:

FIRST: PARTIES

The following are parties to the present agreement:

a. Truth and Reconciliation Commission
THE COMMISSION is an institution created through Supreme Decree N° 065-2001-PCM on June 4th, 2001, aimed at clarifying the process, facts and responsibilities of terrorist violence and violation of human rights produced from May 1980 to November 2000, attributable both to terrorist organizations and to State agents. It also aims at proposing initiatives to strengthen peace and concord among Peruvians. It promotes national reconciliation, the rule of law and the strengthening of the constitutional democratic regime.

By virtue of its mandate, the CVR may request cooperation from public and private institutions and citizens at large whenever it considers it relevant

b. The Network for the Development of Social Sciences in Peru
The Network is an academic consortium made up by Pontificia Universidad Católica del Perú, Universidad del Pacífico and Instituto de Estudios Peruanos, devoted to promoting the institutional development of social sciences in Peru and to contribute to the renovation of scientific knowledge on the most urgent social, political and cultural problems of Peruvian society.

SECOND: COMMON INTERESTS

THE COMMISSION and THE NETWORK are the mutual interest and purpose of going towards national reconciliation based upon the rule of law and the strengthening of the constitutional democratic regime. To this end, they agree to join efforts and develop actions that contribute to reconstruct historical memory, seeking to build a communication space among all Peruvians, finding out truth and contributing to reconciliation and peace

THIRD: OBJECTIVE

THE NETWORK has created a project called “Houses of Memory” to house our artistic and cultural expressions of the period between 1980 and 2000 and to exhibit them in different places of the country. The “Network of Houses of Memory in Peru” arises from citizen initiative to mobilize efforts so as to institute a symbolic, pedagogic and creative space where Peruvians can learn to coexist based upon democratic, tolerant and fair relations. It is aimed at building a symbolic space of citizen convergence, from which to convoke the institutions and forces of the country to produce a new national narrative based upon the acknowledgement of diversity and equality of Peruvians.

THE COMMISSION though its photograph project has been invited to participate in the pilot project of “Houses of Memory” to be inaugurated on November 25th in La Casona de San Marcos and that will be presented in different provinces of Peru until May 31st, 2003.

This agreement is aimed at establishing the conditions in which THE COMMISSION shall participate in the “Houses of Memory” project and THE NETWORK’S commitment in implementing said project in connection with THE COMMISSION.

FOURTH: COMMITMENT OF THE PARTIES

THE COMMISSION commits itself to:

  • Provide as gratuitous bailment the six (6) black and white billboards measuring 2.10cm x 1.15cm, encapsulated, each in perfect condition, that follow:
    Celestino Ccente, Oscar Medrano, photography, Caretas archive
    Complaint for a missing person, Vera Lentz photography.
    Policeman funeral, Vera Lentz photography.
    Lucio, Cecilia Larrabure photography.
    Armed strike, Walter Chiara photography, TAFOS-PUCP archive
    Ashaninka woman, Alejandro Balaguer photography.
    Printings in A4 sheets are attached to these images, according to this agreement.

THE NETWORK commits itself to:

  • Sensitize the communities where they work on the need and importance of finding out truth, the rule of law and redress, as well as their relationship with the construction of a comprehensive and sustainable development of the community.
  • Disseminate THE COMMISSION’S work through the exhibition of these billboards.
  • Exhibit the billboards in an appropriate place according to standards pointed out by THE COMMISSION.
  • Use the billboards only the in the aforementioned project. They can also be shown by the members of the Houses of Memory project, only when said project is to be promoted.
  • Care for the custody and conservation of billboards as diligently and carefully as possible, being liable for their loss or deterioration produced due to reasons beyond their normal wear and tear.
  • Permit the Commission through the Photograph Project, to inspect these billboards whenever it deems convenient.
  • Giving the billboards back in the same condition they received them on June 1st, 2003.

FIFTH: SPECIFIC PROHIBITION

The reproduction of these billboards in any means by THE NETWORK is expressly prohibited hereby.

SIXTH: SPECIFIC AGREEMENTS

Specific agreements can be reached in connection with the commitments assumed in the preceding clause expanding or amending their scopes or on different topics provided that they are related with the objective of this agreement. These agreements shall establish their scope, objective, duration, and parties’ duties.

SEVENTH: OPERATIONAL COORDINATORS

For the better compliance with this agreement’s objectives, the following operational coordinators are appointed by the parties. They will be in charge of coordinating actions so they are fully complied with.

EIGHT: FUNDING

THE NETWORK commits itself to find funding for developing the project.

NINTH: RESOLUTION

Non-compliance of any of the commitments and obligations assumed by the parties may give way to agreement resolution.

TENTH: TERM

This agreement shall be effective from the date it is signed and will be effective until THE COMMISSION completes the task conferred upon it by Supreme Decree Nº 065-2001-PCM, unless any of the parties communicates the other party in written form and with one month’s notice, its intention of resolving it.

In conformity with the contents and scope of this agreement, the parties sign it in original document and two equally valid copies in Lima on the 20th day of November 2002.
